TERMS OF USE AGREEMENT

This Terms of Use Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and Deep Solutions Ltd. ("Company", "we", "us", or "our") for the use of our software as a service ("SaaS") product ("Service").

BY ACCESSING OR USING OUR SERVICE, YOU ARE ACCEPTING AND AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE OR ACCESS OUR SERVICE.

1. SERVICE

  1. The Service is provided "as is," and we grant you a non-exclusive, non-transferable, and limited right to access and use the Service.
  1. While we offer free use of our services for specified durations based on the chosen plan, please be informed that the number of tries or usages within these free periods is capped at 100. Once a user reaches this limit, they will no longer be able to use the service until the free period ends or they choose to upgrade to a different plan. We reserve the right to enforce this limitation to ensure optimal service performance for all our users.

2. PAYMENT AND REFUNDS

  1. Payment for the Service is due upfront and is non-refundable. By agreeing to these Terms, you acknowledge and agree that the Company is not obligated to provide a refund for any reason after the Service has been purchased.
  2. We reserve the right to change our fees at any time at our sole discretion, subject to providing you with reasonable prior notice.

3. PROPRIETARY RIGHTS

  1. We own all proprietary rights in the Service, including, but not limited to, patents, trademarks, service marks, trade secrets, copyrights, and other intellectual property rights.

4. AGE RESTRICTION

  1. The Service is intended for individuals who are 18 years of age or older. By using the Service, you represent and warrant that you are 18 years of age or older.

5. PRIVACY NOTICE

  1. We do not store images uploaded or processed through the Service. As part of our commitment to user privacy, all images are processed securely, and we do not retain any copies of the images beyond what is necessary for the immediate functionality of the Service.

6. LIMITATION OF LIABILITY

  1. In no event will we be liable for any indirect, special, incidental, consequential, or exemplary damages arising out of or related to this agreement or the use of the Service.

7. GOVERNING LAW

  1. This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws rules.

8. CHANGES TO THIS AGREEMENT

  1. We reserve the right to modify this Agreement at any time, and without prior notice, by posting amended terms on our website. Your continued use of the Service indicates your acceptance of the amended Agreement.
